Listers

These Terms & Conditions (“Terms”) apply to all users who list properties for auction on ApartmentDibs (“Lister,” “you,” or “your”). By creating a listing, you agree to the following:

1. Eligibility

You represent that you are the property owner, authorized manager, or authorized broker and that you have the legal right to lease the property you are listing.

2. Auctions and Bidder Selection

• You set your own listing details, including qualification criteria for Bidders.

• Only verified Bidders who meet your stated criteria will be allowed to participate.

• If a Bidder wins your auction and meets your criteria, including reserve bid amount, you agree to rent to that Bidder in good faith.

3. Failure to Honor Winning Bids

If you choose not to rent to the winning Bidder despite them meeting your stated criteria, unless you are unable to proceed due to extenuating circumstances outside your reasonable control (such as property damage, legal restrictions, or material misrepresentation by the Bidder), ApartmentDibs reserves the right to:

• Charge you a fee in the amount of 15% of one month’s rent as dictated by the winning bid.

• Suspend or permanently ban you from the platform.

4. Fees and Payments

ApartmentDibs may charge service fees for listings, transactions, or penalties as outlined during the listing process.

5. Platform Integrity

You agree not to circumvent the platform, manipulate auctions, or misrepresent property details.

6. Termination

We may suspend or terminate your account at any time if you violate these Terms or harm the integrity of the marketplace.

7. Limitation of Liability

ApartmentDibs provides the platform “as is” and is not responsible for disputes between Listers and Bidders beyond enforcing these Terms.

Bidders

These Terms & Conditions (“Terms”) apply to all users who place bids on property auctions on ApartmentDibs (“Bidder,” “you,” or “your”). By entering an auction, you agree to the following:

1. Eligibility

You must be at least 18 years old and legally able to enter into a lease agreement. Attestation of auction criteria qualification may be required per auction.

2. Bidding and Commitments

• You may only bid if you intend to rent the apartment if you win.

• By placing a bid, you represent that you meet the Lister’s qualification criteria.

3. Winning Bids

If you win an auction, you are expected to follow through with the lease in good faith.

4. Failure to Honor Winning Bids

If you choose not to proceed with the lease after winning an auction, unless you are unable to proceed due to extenuating circumstances outside your reasonable control (such as unexpected job loss, major health event, or material misrepresentation by the Lister), ApartmentDibs reserves the right to:

• Charge you a fee in the amount of 15% of one month’s rent as dictated by the winning bid.

• Suspend or permanently ban you from the platform.

5. Fees and Payments

ApartmentDibs may charge fees or penalties as outlined during the bidding process.

6. Platform Integrity

You agree not to manipulate auctions, submit false qualifications, or attempt to bypass the platform.

7. Termination

We may suspend or terminate your account if you violate these Terms or harm the integrity of the marketplace.

ApartmentDibs provides the platform “as is” and is not responsible for disputes between Bidders and Listers beyond enforcing these Terms.
